ການດໍາເນີນທຸລະກິດນໍ້າມັນເຊື້ອໄຟ

• ເປັນບັນຫາທີ່ນັກທຸລະກິດຫຼາຍທ່ານຕັ້ງຂຶ້ນກ່ຽວກັບຂັ້ນຕອນການຂໍອະນຸຍາດດໍາເນີນກິດຈະການປໍ້ານໍ້າມັນໃນເຂດຫ່າງໄກສອກຫຼີກວ່າການສະໜອງຂໍ້ມູນ ແລະ ການແຈ້ງຕອບຜູ້ປະກອບການຢາກໃຫ້ມີຄວາມວ່ອງໄວ ແລະ ຊັດເຈນ.

ກ່ຽວກັບເລື່ອງນີ້ ທ່ານ ສອນໄຊ ສີພັນດອນ ຮອງນາຍົກລັດຖະມົນຕີ, ລັດຖະມົນຕີກະຊວງແຜນການ ແລະ ການລົງທຶນໄດ້ຊີ້ແຈງຕໍ່ກອງປະຊຸມສາມັນເທື່ອທີ 09 ຂອງສະພາແຫ່ງຊາດຊຸດທີ VIII ຜ່ານມານີ້ວ່າ:

• ໂດຍປະຕິບັດຕາມຄໍາສັ່ງວ່າດ້ວຍການປັບປຸງລະບຽບການ ແລະ ກົນໄກປະສານງານໃນການດໍາເນີນທຸລະກິດ ຢູ່ ສປປ ລາວ ສະບັບເລກທີ 02/ນຍ ລົງວັນທີ 01 ກຸມພາ 2018, ກະຊວງ ອຸດສາຫະກໍາ ແລະ ການຄ້າ ໄດ້ປັບປຸງລະບົບການແຈ້ງຂຶ້ນທະບຽນວິສາຫະກິດ ໂດຍໄດ້ອອກຂໍ້ຕົກລົງວ່າດ້ວຍການຂຶ້ນທະບຽນວິສາຫະກິດ ສະບັບເລກທີ 0023/ອຄ.ກທຄວ ລົງວັນທີ 09 ມັງກອນ 2019 ເຊິ່ງໄດ້ເຮັດໃຫ້ການຂຶ້ນທະບຽນວິສາຫະກິດ ສະດວກ, ງ່າຍດາຍ ແລະ ສາມາດຈັດຕັ້ງປະຕິບັດໄດ້ແຕ່ຂັ້ນສູນກາງເຖິງທ້ອງຖິ່ນ. ສະເພາະຂັ້ນຕອນ ການບໍລິການອອກໃບທະບຽນວິສາຫະກິດໂດຍສະເລ່ຍໃຊ້ເວລາພຽງ 3 ວັນ. ນອກຈາກນັ້ນ, ກໍໄດ້ເປີດເວບໄຊຖານຂໍ້ມູນທຸລະກິດແຫ່ງຊາດ (www.erm.gov.la) ເພື່ອອໍານວຍຄວາມສະດວກໃຫ້ແກ່ ນັກລົງທຶນ ແລະ ນັກທຸລະກິດ ໃນການຂຶ້ນທະບຽນວິສາຫະກິດ, ກວດສອບຊື່ວິສາຫະກິດ, ດາວໂຫຼດຄໍາຮ້ອງ-ແບບຟອມ ແລະ ເຂົ້າເຖິງຄ່າທໍານຽມ, ຂັ້ນຕອນໃນການແຈ້ງຂຶ້ນທະບຽນວິສາຫະກິດ ແລະ ຂໍ້ມູນວິສາຫະກິດອື່ນໆ.
• ກ່ຽວກັບການອະນຸຍາດສ້າງຕັ້ງ ແລະ ການດໍາເນີນທຸລະກິດ ນໍ້າມັນເຊື້ອໄຟ ທັງບໍລິສັດນໍາເຂົ້າ ແລະ ສົ່ງອອກ ນໍ້າມັນເຊື້ອໄຟ ແລະ ປໍ້າຈໍາໜ່າຍນໍ້າມັນເຊື້ອໄຟ ແມ່ນກະຊວງອຸດສາຫະກໍາ ແລະ ການຄ້າ ກໍາລັງດໍາເນີນການດັດສົມ ຕາມດໍາລັດວ່າດ້ວຍທຸລະກິດ ນໍ້າມັນເຊື້ອໄຟ ສະບັບເລກທີ 331/ນຍ, ລົງວັນທີ 27 ຕຸລາ 2017 ຊຶ່ງດໍາລັດດັ່ງກ່າວພ້ອມດ້ວຍນິຕິກໍາກ່ຽວຂ້ອງໄດ້ກໍານົດໃຫ້ດັດສົມ ບໍລິສັດນໍາເຂົ້າ ແລະ ສົ່ງອອກນໍ້າມັນເຊື້ອໄຟ ໃຫ້ໄດ້ຕາມເງື່ອນໄຂ ທີ່ກໍານົດໃນດໍາລັດ ແລະ ໃຫ້ສໍາເລັດກ່ອນວັນທີ 01 ມິຖຸນາ 2019, ສໍາລັບປໍ້ານໍ້າມັນເຊື້ອໄຟ ແມ່ນໃຫ້ແລ້ວກ່ອນ ວັນທີ 01 ມິຖຸນາ 2020. ໃນໄລຍະໃຫ້ດໍາເນີນການດັດສົມນີ້ແມ່ນກະຊວງອຸດສາຫະກໍາ ແລະ ການຄ້າ ໄດ້ອອກແຈ້ງການໃຫ້ໂຈະການ ພິຈາລະນາການສະເໜີສ້າງຕັ້ງໃໝ່ (ໂຈະການອອກໃບທະບຽນວິສາຫະກິດ ແລະ ໃບອະນຸຍາດດໍາເນີນທຸລະກິດໃຫ້ແກ່ ທຸລະກິດ ນໍ້າມັນເຊື້ອໄຟ). ປັດຈຸບັນ ກະຊວງອຸດສາຫະກໍາ ແລະ ການຄ້າ ກໍາລັງເກັບກໍາສັງລວມ ຫົວໜ່ວຍທຸລະກິດນໍ້າມັນເຊື້ອໄຟ ທີ່ບໍ່ສາມາດດັດສົມສໍາເລັດ ຕາມກໍານົດເວລາ ແລະ ຈະຄົ້ນຄ້ວາພິຈາລະນາແກ້ໄຂ. ຈາກນັ້ນ ຈຶ່ງພິຈາລະນາກ່ຽວກັບການສະເໜີສ້າງຕັ້ງໃໝ່, ແຕ່ໃນກໍລະນີ ຫາກມີຄວາມຈໍາເປັນແທ້ເຊັ່ນ ການສ້າງຕັ້ງນໍ້າມັນ ຢູ່ເຂດຫ່າງໄກສອກຫຼີກ ດັ່ງກໍລະນີຢູ່ແຂວງ ຄໍາມ່ວນ ທີ່ສະມາຊິກແຫ່ງຊາດ ໄດ້ສະເໜີໃນມື້ທີ່ຜ່ານມານັ້ນ ສາມາດພິຈາລະນາໄດ້ຕາມສະພາບຄວາມເປັນຈິງຢ່າງສົມເຫດຜົນ ໂດຍສອດຄ່ອງຕາມເງື່ອນໄຂ ແລະ ຂັ້ນຕອນທີ່ກໍານົດໃນດໍາລັດເລກທີ 331/ນຍ, ເພາະທຸລະກິດນໍ້າມັນເຊື້ອໄຟນີ້ ຜ່ານມາໄດ້ສ້າງຕັ້ງຂຶ້ນຫຼາຍເຮັດໃຫ້ພົບຄວາມຫຍຸ້ງຍາກໃນການຄຸ້ມຄອງ, ລັດຖະບານ  ຈຶ່ງໄດ້ຊີ້ນໍາໃຫ້ກະຊວງ ອຸດສາຫະກໍາ ແລະ ການຄ້າ ປະສານສົມທົບກະຊວງກ່ຽວຂ້ອງຄົ້ນຄ້ວາສ້າງນິຕິກໍາເພື່ອດັດສົມທຸລະກິດດັ່ງກ່າວ.(ລາຍລະອຽດການສຳພາດເພີ່ມຕື່ມສາມາດຊອກອ່ານໄດ້ໃນວາລະສານທາເກັດ ສະບັບ 172 ເດືອນ ທັນວາ 2020 ໄດ້ທີ ສຳນັກງານຫ້ອງການພາກລັດ ແລະ ເອກະຊົນ, ຫ້ອງສະໝຸດ, ຮ້ານອາຫານ, ຮ້ານກາເຟ, ຮ້ານ kaogee cafe ແລະ ຫຼາຍໆບ່ອນໃນນະຄອນຫຼວງ ຫຼື ສອບຖາມຈອງເປັນສະມາຊິກໄດ້ທີ່ເບີ 021 216 666)

Operating petroleum business

• Many people are inquiring information about processes for operating a gas station in a remote area, while urging for a quick and clear supply of information as well as notification to entrepreneurs.

For this matter, Mr. Sonexay Siphandone, Deputy Prime Minister, Minister of Planning and Investment, explained at the 9^th Ordinary Session of the National Assembly 8^th Legislature held recently that:

• In compliance with the Prime Minister’s Order on the Improvement of Regulations and Coordination Mechanism Related to “Doing Business” in the Lao PDR No. 02/PM dated February 1, 2018, Ministry of Industry and Commerce has enhanced its business registration notification system by issuing the Decision on Enterprise Registration No. 0023/MOIC.DERM dated January 09, 2019 to help making business registration at both the central and local level more convenient, simple and practical. For the issuance of enterprise registration certificate, this process takes only 3 days on average. Moreover, a website serving as the national business database (www.erm.gov.la) was launched to help facilitating investors and businesspeople in registering their business, examining their business title, downloading application forms, and accessing information pertaining to fees, processes for registering business as well as other business-related data.
• For permission to establish and operate a petroleum business in the form of fuel import-export company as well as gas station, Ministry of Industry and Commerce is in the process of regulating such request in accordance with the Decree on Petroleum Business No. 331/PM, dated October 27, 2017. This decree together with concern laws request the government to ensure that fuel import-export company as well as gas station are able to meet the criteria set by the decree before June 1, 2019 and June 1, 2020 respectively. During this regulatory period, Ministry of Industry and Commerce has stopped considering new business establishment proposals (stopped issuing enterprise registration certificate and business operating license to a petroleum business). Currently, Ministry of Industry and Commerce is now counting number of petroleum business units who have not yet been properly regulated in order to consider ways to solve this issue. After that, the ministry will then start to consider new business establishment proposals. Except for the highly necessary case like the establishment of a gas station in a remote area in Khammouan Province proposed by the Member of the National Assembly which can be considered properly based on the actual situation, conditions and processes stipulated in the Decree No. 331/PM.
