ຄວາມຮຸນແຮງໃນຄອບຄົວ ບັນຫາທີ່ບໍ່ຄວນເບິ່ງຂ້າມ

ການໃຊ້ຄວາມຮຸນແຮງຕໍ່ແມ່ຍິງ ແລະ ເດັກນ້ອຍ ຖືໄດ້ວ່າເປັນອີກປະກົດການຫຍໍ້ທໍ້ໜຶ່ງຂອງສັງຄົມ ທີ່ເກີດຂຶ້ນຢູ່ໃນທົ່ວໂລກທີ່ມີມາແຕ່ດົນນານແລ້ວ ເຊິ່ງເມື່ອກ່ອນ ຜູ້ຊາຍສ່ວນໃຫຍ່ມັກຍຶດຖືແນວຄວາມຄິດທີ່ວ່າ ຕົນເອງເປັນຜູ້ນໍາຄອບຄົວ ເປັນຜູ້ລ້ຽງດູຄອບຄົວ ຍ່ອມມີອໍານາດໃນການຊີ້ຂາດ ບັນຫາທຸກຢ່າງໃນຄອບຄົວ, ຖ້າຫາກ ສະມາຊິກ ພາຍໃນຄອບຄົວຫາກ ບໍ່ເຊື່ອຟັງກໍມັກຈະຖືກລົງໂທດ ດ້ວຍການໃຊ້ຄວາມຮຸນແຮງ ຫຼື ເຮັດໃຫ້ເຈັບປວດ ໃນ 4 ດ້ານເຊັ່ນ: ຄວາມຮຸນແຮງຕໍ່ຮ່າງກາຍ, ຕໍ່ຈິດໃຈ, ທາງເພດ ແລະ ເສດຖະກິດ.

ນອກຈາກນີ້ ການໃຊ້ຄວາມຮຸນແຮງຍັງທະວີຄວາມຮຸນແຮງຂຶ້ນ ຈາກປັດໄຈກະຕຸ້ນເຊັ່ນ: ດື່ມເຫຼົ້າເມົາ ຫຼື ໃຊ້ຢາເສບຕິດ ພາໃຫ້ຜິດຖຽງກັນຈົນເຖິງຂັ້ນລົງມື, ເຫດຜົນເລື່ອງເສດຖະກິດຂອງຄອບຄົວ ຫຼື ປັດໄຈອື່ນໆ. ຢ່າລືມວ່າແມ່ຍິງ ແລະ ເດັກນ້ອຍທົ່ວໂລກ ມີຈຳນວນກວ່າເຄິ່ງໜຶ່ງຂອງປະຊາກອນ ສະນັ້ນ ການທີີ່ເຂົາເຈົ້າຕ້ອງປະເຊີນກັບບັນຫາຄວາມຮູນແຮງເຮັດໃຫ້ບໍ່ສາມາດພັດທະນາຕົນເອງ ແລະ ເຂົ້າເຖິງໂອກາດທາງເສດຖະກິດໄດ້ ຈຶ່ງເປັນບັນຫາໃຫຍ່ທີ່ຖ່ວງດຶງການພັດທະນາໃນລະດັບຊາດເຊັ່ນກັນ ນອກຈາກນີ້ ລາຍຈ່າຍໃນການແກ້ໄຂບັນຫາຄວາມຮຸນແຮງ ທີ່ລັດຖະບານ ແລະ ສັງຄົມຕ້ອງໃຊ້ຈ່າຍໄປໃນທົ່ວໂລກກໍມະຫາສານເຊັ່ນດຽວກັນ ບໍ່ວ່າຈະເປັນ ຄ່າໃຊ້ຈ່າຍໃນການປົວແປງສຸຂະພາບກາຍ, ສຸຂະພາບຈິດ ແລະ ຊັບສິນທີ່ເສຍຫາຍໄປນຳອີກ

ສະນັ້ນ, ໃນປັດຈຸບັນ ບັນດາປະເທດຕ່າງໆໃນໂລກ, ລວມທັງ ສປປ ລາວ ຈຶ່ງໃຫ້ຄວາມສໍາຄັນກັບການຕ້ານການໃຊ້ຄວາມຮຸນແຮງຕໍ່ແມ່ຍິງ ແລະ ເດັກນ້ອຍ ໂດຍການວາງລະບຽບກົດໝາຍ, ຍົກສູງຄວາມສະເໝີພາບທາງດ້ານກົດໝາຍ ແລະ ຄວາມເທົ່າທຽມກັນ ລະຫວ່າງ ຍິງ ແລະ ຊາຍ. ແຕ່ເຖິງຢ່າງໃດກໍຕາມ ການໃຊ້ຄວາມຮຸນແຮງຕໍ່ກັບແມ່ຍິງ ແລະ ເດັກນ້ອຍຢູ່ໃນຄອບຄົວ ກໍຍັງຄົງມີໃຫ້ເຫັນຢູ່ເລື້ອຍໆ, ສະນັ້ນ ໃນບົດຄວາມນີ້ ຂ້າພະເຈົ້າ ຂໍເປັນສ່ວນໜຶ່ງ ໃນການຕ້ານການໃຊ້ຄວາມຮຸນແຮງ ດັ່ງກ່າວ ດ້ວຍການໃຫ້ຂໍ້ມູນທາງດ້ານກົດໝາຍ ທີ່ອາດຈະເປັນປະໂຫຍດ ໃຫ້ແກ່ຜູ້ອ່ານ ດັ່ງລຸ່ມນີ້:

ໃນດ້ານກົດໝາຍແລ້ວ ການໃຊ້ຄວາມຮຸນແຮງ ເຊັ່ນ: ທໍາຮ້າຍຮ່າງກາຍ, ໃຊ້ກໍາລັງນາບຂູ່, ບັງຄັບ, ຫຼື ດ້ວຍຮູບການໃດໜຶ່ງ ບໍ່ວ່າຈະເຮັດຂຶ້ນກັບບຸກຄົນໃດກໍຕາມ ເຊິ່ງເປັນການສ້າງຄວາມເສຍຫາຍທາງດ້ານ ຮ່າງກາຍ, ຈິດໃຈ ຫຼື ຊັບສິນ ກໍລ້ວນແລ້ວແຕ່ເປັນການກະທໍາຜິດກົດໝາຍ, ເຊິ່ງຜູ້ທີ່ໃຊ້ຄວາມຮຸນແຮງນັ້ນ ແມ່ນມີຄວາມຮັບຜິດຊອບ ໂດຍອີງຕາມ ລະດັບຄວາມເປັນອັນຕະລາຍຂອງ ການກະທໍາຜິດ ດັ່ງລຸ່ມນີ້:

  1. ການກະທໍາຜິດ ທີ່ບໍ່ເປັນອັນຕະລາຍຮ້າຍແຮງ

ກໍລະນີທີ່ເປັນການກະທໍາທີ່ບໍ່ເປັນອັນຕະລາຍຮ້າຍແຮງ ເຊັ່ນ: ການທໍາຮ້າຍຮ່າງກາຍທີ່ບໍ່ໄດ້ຮັບບາດເຈັບສາຫັດ, ບໍ່ໄດ້ເສຍອົງຄະ ຫຼື ເສຍຊີວິດ ແມ່ນໃຫ້ທໍາການສຶກສາອົບຮົມ ຜູ້ທີ່ໃຊ້ຄວາມຮຸນແຮງນັ້ນ ໃຫ້ຮູ້ເຖິງຜົນຮ້າຍ, ຄວາມເຈັບປວດ ທີ່ຜູ້ຖືກເຄາະຮ້າຍໄດ້ຮັບ, ທັງນີ້ກໍເພື່ອເປັນການຮັກສາສາຍສໍາພັນອັນດີ ພາຍໃນຄອບຄົວຕໍ່ໄປ ໂດຍອີງຕາມກົດໝາຍ ວ່າດ້ວຍ ການພັດທະນາ ແລະ ປົກປ້ອງແມ່ຍິງ ສະບັບເລກທີ 08/ສພຊ, ລົງວັນທີ 22 ຕຸລາ 2004, ມາດຕາ 36 ວັກ 01 ເຊິ່ງກໍານົດວ່າ:

ເມື່ອໄດ້ຮັບແຈ້ງຄວາມຈາກ ໜ່ວຍໄກ່ເກ່ຍຂັ້ນບ້ານ, ໜ່ວຍງານໃຫ້ຄໍາປຶກສາ, ຜູ້ຖືກເຄາະຮ້າຍ ຫຼື ຜູ້ຕາງໜ້າຂອງຜູ້ກ່ຽວແລ້ວ ເຈົ້າໜ້າທີ່ຕໍາຫຼວດ ຕ້ອງດໍາເນີນການບົນພື້ນຖານຄວາມສາມັກຄີປອງດອງ ແລະ ຄວາມຜາສຸກຂອງ ຄອບຄົວ. ຖ້າຄວາມຮຸນແຮງ ຫາກບໍ່ເປັນອັນຕະລາຍຮ້າຍແຮງ ກໍໃຫ້ພະຍາຍາມໄກ່ເກ່ຍ, ສຶກສາອົບຮົມຄູ່ກໍລະນີໃຫ້ຄືນດີ ແລະ ໄວ້ເນື້ອເຊື່ອໃຈກັນ ແລະ ກັນ.”   

  1. ການກະທໍາຜິດ ທີ່ເປັນອັນຕະລາຍຮ້າຍແຮງ

ໂດຍອີງຕາມ ກົດໝາຍວ່າດ້ວຍການພັດທະນາ ແລະ ປົກປ້ອງແມ່ຍິງ ສະບັບເລກທີ 08/ສພຊ, ລົງວັນທີ 22 ຕຸລາ 2004, ມາດຕາ 36 ວັກ 02 ກໍານົດວ່າ: “…ມີຄວາມຮຸນແຮງ ທີ່ເປັນອັນຕະລາຍຮ້າຍແຮງນັ້ນໃຫ້ເຈົ້າໜ້າທີ່ດໍາເນີນຄະດີ ແລະ ນໍາໃຊ້ມາດຕະການຕ່າງໆຕາມທີ່ກໍານົດໄວ້ໃນກົດໝາຍ” ແລະ ວັກ 03 ກໍານົດວ່າ: ໃນການດໍາເນີນຄະດີ ນັ້ນ ຖ້າຫາກມີຫຼັກຖານ ຢັ້ງຢືນວ່າເປັນການກະທໍາຜິດທາງອາຍາແລ້ວໃຫ້ປະກອບສໍານວນ ຄະດີສົ່ງໃຫ້ໄອຍະການ ເພື່ອພິຈາລະນາສັ່ງຟ້ອງຂຶ້ນສານຕາມກົດໝາຍ.”  

ຈາກມາດຕາດັ່ງກ່າວຂ້າງເທິງນີ້ ສາມາດສະຫຼຸບໄດ້ວ່າ: ໃນກໍລະນີທີ່ເປັນການກະທໍາຜິດທີ່ມີລັກສະນະຮ້າຍແຮງເຊັ່ນ: ການທໍາຮ້າຍຮ່າງກາຍ ຈົນໄດ້ຮັບບາດເຈັບສາຫັດ, ເສຍອົງຄະ ຫຼື ເສຍຊີວິດ, ຜູ້ກະທໍາຜິດ ກໍຈະຖືກດໍາເນີນຄະດີ ໂດຍໄດ້ຮັບໂທດຕາມສະຖານທີ່ຕົນໄດ້ກະທໍາຜິດ ຕາມທີ່ກໍານົດໄວ້ໃນປະມວນກົດໝາຍອາຍາ. ນອກຈາກນີ້ ການກະທໍາຜິດ ຕໍ່ເດັກ ທີ່ມີອາຍຸຕໍ່າກວ່າ 18 ປີ ຍັງເປັນສາເຫດໃຫ້ ສານ ສາມາດເພີ່ມໂທດໃຫ້ແກ່ ຜູ້ທີ່ກະທໍາຜິດອີກດ້ວຍ ຕາມທີ່ໄດ້ກໍານົດໄວ້ໃນ ມາດຕາ 65 ຂໍ້ 6 ຂອງປະມວນກົດໝາຍອາຍາ ສະບັບປີ 2017.

Domestic violence, an unignorable issue

Violence against woman and child is one of the social ills occurred all over the world from the very long time ago. In the previous years, most men were strict with the concept that they are heads of families and take care of families so they thought they had a power to decide on every matter in the families. If any member of the families does not follow them, he/she will be punished by the use of violence or causing physical, mental, sexual and economic suffers.

In addition to that, the use of violence becomes more serious when other factors involve such as being intoxicated or high which cause argument and physical violence, other economic reasons of the families or other factors. Keep in mind that the number of women and children is half of the total population. Therefore, by suffering from the violence, they are unable to develop themselves and access to economic opportunities which is also one of the significant issue that delays the national development. Besides, the expense that the government and societies has to pay globally in order to solve the violence is huge and such expense is for physical, mental health treatments and damaged assets.

Now, therefore, various countries in the world, including Lao PDR, significantly aim at countering the violence against woman and child by issuing laws and regulations, promoting gender equality in accordance with laws and gender equity. However, the violence against woman and child is still extant. Thus, in this article, I would like be a part to counter the violence against woman and child by providing the following legal information which might be useful for readers:

In the legal perspective, the use of violence such as: physical assault, the use of force to threaten, coerce or any similar form regardless of doing it under the order of others which cause physical, mental effect or damage to assets is considered violating the laws and a violator is responsible for such act based on the severity of such act as follows:

  1. Non-harmful violation

In case of non-harmful violation such as: physical assault with non-serious injury, without losing limbs or causing death, a violator will be subject to education to understand about the negative effect, suffer that the victim faces. This method is to keep good relationship within the family in accordance with paragraph 01, Article 36 of the Law on Development and Protection of Woman and Child No. 08/NA, dated 22 October 2004 which states that:

After receiving report from the village mediation committee, an advising agency, a victim or his/her representative, a police offer must solve the issue in an amicable manner. In case of a non-serious violence, an effort of mediating, educating the litigants to reconcile and trust each other shall be applied.

  1. Harmful violation

Pursuant to paragraph 02, Article 36 of the Law on Development and Protection of Woman and Child No. 08/NA, dated 22 October 2004 which states that …with harmful violation, a police officer shall proceed and apply various measures stipulated in law and paragraph 3 which states that “in the case proceeding, if there is evidence proving that it is a criminal violation, a police officer shall prepare a case file and submit it to a public prosecutor to consider and claim it to the court of justice in accordance with law.

From the above articles, it can be concluded that in case of serious violation such as physical assault with serious injury, loss of limb or life, a violator shall be prosecuted and receive penalty related to his/her violation as stipulated in the Penal Code. Moreover, in case of using violence again child under 18 years of age, the court may use that as a reason to increase penalty imposed on the violator as stipulated in clause 6, Article 65 of Penal Code of 2017.
