ດອກເບ້ຍຕາມກົດໝາຍ

ກົດໝາຍລາວຮັບຮູ້ສິດເສລີພາບໃນການສະແດງເຈດຈຳນົງຂອງຄູ່ສັນຍາ ແຕ່ເຈດຈຳນົງຂອງຄູ່ສັນຍານີ້ ຕ້ອງບໍ່ຂັດກັບກົດໝາຍ ແລະ ຄວາມເປັນລະບຽບຮຽບຮ້ອຍຂອງສັງຄົມ ໝາຍຄວາມວ່າ ຄູ່ສັນຍາຈະຕົກລົງເຫັນດີນຳກັນອັນໃດກໍໄດ້ທີ່ບໍ່ຂັດກັບກົດໝາຍ. ມື້ນີ້ ຂໍນຳສະເໜີກ່ຽວກັບເລື່ອງດອກເບ້ຍຂອງການກກູ້ຢືມ ຊຶ່ງຂ້າພະເຈົ້າໄດ້ສະເໜີກ່ຽວກັບດອກເບ້ຍ ໃນສະບັບກ່ອນໜ້ານີ້ ເຊິ່ງມີທ່ານຜູ້ອ່ານໃຫ້ຄວາມສົນໃຈ ແລະ ສອບຖາມມາຕື່ມອີກ ໂດຍສະເພາະໃນປະເດັນທີ່ວ່າ ຖ້າຫາກຄູ່ສັນຍາສາມາດຕົກລົງກັນກຳນົດດອກເບ້ຍໃນການກູ້ຢືມສູງ ຈະມີຜົນທາງດ້ານກົດໝາຍແນວໃດ.

ກ່ອນອື່ນໝົດ, ເພື່ອຕອບຄຳຖາມນີ້ ຂ້າພະເຈົ້າ ສະເໜີໃຫ້ທ່ານຜູ້ອ່ານເບິ່ງບາງສ່ວນສຳຄັນຂອງມາດຕາ 412 ແລະ ມາດຕາ 413 ຂອງປະມວນກົດໝາຍແພ່ງລາວກ່ຽວກັບດອກເບ້ຍຂອງການກູ້ຢືມ (ປະມວນກົດໝາຍແພ່ງສະບັບທຳອິດຂອງ ສປປ ລາວ ໄດ້ຮັບຮອງຈາກສະພາແຫ່ງຊາດ ໃນວັນທີ 6 ທັນວາ 2018 ແລະ ຈະໄດ້ປະກາດໃຊ້ໃນໄວໆນີ້) ດັ່ງນີ້:

  1. ສັນຍາກູ້ຢືມເງິນ ຕ້ອງໄດ້ເຮັດເປັນລາຍລັກອັກສອນເທົ່ານັ້ນຈຶ່ງມີຜົນບັງຄັບໃຊ້ຕາມກົດໝາຍ-ບໍ່ເຮັດເປັນລາຍລັກອັກສອນຖືເປັນໂມຄະ-ບໍ່ມີຜົນບັງຄັບໃຊ້; ແຕ່ຜູ້ທີ່ຮັບເງິນໄປແລ້ວນັ້ນຕ້ອງສົ່ງຄືນໃຫ້ຜູ້ເອົາເງິນໃຫ້ ຫຼື ຜູ້ໃຫ້ກູ້ຢືມເງິນ.
  2. ຖ້າສັນຍາກູ້ຢືມເງິນບໍ່ໄດ້ກຳນົດເລື່ອງດອກເບ້ຍໄວ້ໃນສັນຍາ, ສານ ບໍ່ພິຈາລະນາເລື່ອງດອກເບ້ຍໃຫ້ຖ້າຫາກຮ້ອງຟ້ອງສານໃນເລື່ອງການບັງຄັບປະຕິບັດສັນຍາກູ້ຢືມເງິນ.
  3. ຄູ່ສັນຍາອາດຈະຄິດໄລ່ດອກເບັ້ຍເທົ່າໃດກໍໄດ້ຕາມການຕົກລົງກັນ ແຕ່ຖ້າມີຂໍ້ຂັດແຍ່ງ ແລະ ສະເໜີໃຫ້ສານພິຈາລະນາຕັດສິນ ສານຈະນຳມາຄິດໄລ່ດອກເບ້ຍຕາມກົດໝາຍ ສຸດສູງບໍ່ເກີນ ສາມສິບຫົກສ່ວນຮ້ອຍ (36 %) ຕໍ່ປີ (ກໍລະນີເປັນການກູ້ຢືມນອກລະບົບທະນາຄານ ຫຼື ສະຖາບັນການເງິນອື່ນ) ແລະ ສານຈະຄິດໄລ່ຄືນໃໝ່ທັງໝົດ ນັບແຕ່ທີ່ໄດ້ຈ່າຍໄປແລ້ວ, ຄ້າງຊຳລະ, ຈົນຮອດມື້ຂໍ້ຂັດແຍ່ງເຖິງສານ ແລະ ລົງຄຳຕັດສີນ.
  4. ສານ ຈະບໍ່ເອົາດອກເບ້ຍເງິນກູ້ຢືມມາເປັນຕົ້ນທຶນ (ດອກທົບຕົ້ນ).

Interest under the Law

            The Lao PDR law recognizes the freedom in expressing intents of contractual parties. However, such intents shall not violate the laws and social order which means that the parties to a contract may agree on any terms which do not violate the laws. Today, I would like to discuss about loan interest which I previously discussed in the last edition, and readers were interested and asked questions about the legal consequence of the situation where the parties agreed on an extremely high interest rate.

First of all, in order to answer this question, I would like you to read the following important sections of Article 412 and 413 of the Civil Code regarding the loan interest (the first civil code of the Lao PDR which was adopted by the National Assembly on 6 December 2018 and will be promulgated soon):

  1. A loan agreement must be made in writing in order to be enforceable. Any loan agreement not executed in writing shall be void and unenforceable, but a borrower who already took loan shall return the loan to a lender.
  2. If a loan agreement does not specify an interest rate, the People’s Court will not consider and decide on the interest if a lawsuit for breach of contract is brought before the court.
  3. Parties to a loan agreement may specify and agree on any interest rate. However, if a dispute arises and a lawsuit is brought to a court, the court will calculate the interest in accordance with the law with maximum rate not exceeding thirty-six percent (36%) per annum. In case of an informal loan, the court will recalculate the interest from the date the loan was paid, outstanding until the date on which the lawsuit is brought before the court and the date of decision.
  4. The court will not allow the compound interest.
