ພາຍຫຼັງທີ່ສານຂັ້ນອຸທອນໄດ້ພິພາກສາແລ້ວ ຖ້າຫາກຝ່າຍໃດໜຶ່ງບໍ່ພໍໃຈ ມີສິດຂໍລົບລ້າງໄປຍັງສານຂັ້ນລົບລ້າງ (ສານປະຊາຊົນສູງສຸດ) ພາຍໃນກໍານົດເວລາ 30 ວັນ ນັບແຕ່ວັນລົງຄໍາພິພາກສາ ຫຼື ວັນຮັບຊາບຄໍາພິພາກສາ ເຊິ່ງສານຂັ້ນລົບລ້າງ ຕ້ອງພິຈາລະນາ ພິພາກສາຄະດີໃຫ້ສໍາເລັດ ພາຍໃນກໍານົດເວລາ 3 ເດືອນ ຕາມມາດຕາ 30 ຂໍ້ 3 ຂອງກົດໝາຍວ່າດ້ວຍການດໍາເນີນຄະດີແພ່ງ ສະບັບປັບປຸງປີ 2012.

Written notification to the violated party is a good way of indicating our disapproval or disagreement with such breach. However, this method is not quite effective due to the absence of a mediator and lack of legal obligation to enforce parties involved. This step proves the sincerity and effort of each party in solving problems and serve as a set of important documents in proceeding to the next step. On the contrary, if both parties are able to reach a consensus, this then becomes the best option as it helps all sides keep their business confidentiality, save time, save cost and maintain good friendship between them as well.

  • Conflict resolution by mediating

Mediation is another way of conflict resolution which is carried out in the form of discussion, compromise and negotiation by a mediator or a mediating committee (Article 25 (revised) of the Law on Economic Dispute Resolution revised in 2018). Mediation can be done at the Economic Dispute Resolution Center (“EDRC”), Ministry of Justice, based on rules set by the center. Apart from the center, you can also mediate at any economic dispute resolution offices available overseas based on the agreement mutually approved within a signed contract. Mediation seeks agreement to any issue to reach satisfaction for all parties involved without using threat. Mediation consists of a mediator or a mediating committee to help all sides reaching agreement without judging who is at fault, but more on how to get both business partners to agree amicably.

Mediation result

All information will be made into a written report to use as a reference for proceeding to the next step. Mediation result is not to expose who loses or who wins, but more on an agreement reached by both parties. If they can reach a compromise, this method then becomes highly effective with legal force starting from the day when the agreement is reached (this is different from a mediation carried out by village authority or police officer). If any party still refuse to compromise, another side can submit the case further to court for a final judgment (Article 52 of the Law on Economic Dispute Resolution revised in 2018).

  • Dispute resolution through arbitration

Arbitration is another method of dispute resolution carried out by arbitrator or a judging committee (Article 34 of the Lao on Economic Dispute Resolution revised in 2018). This way of solving issues is common among business people around the world which can be done at the Economic Dispute Resolution Center, Ministry of Justice, or at any dispute resolution center or office in overseas. The most popular and prestigious center in ASEAN has to be the Singapore International Arbitration Center (“SIAC”). Arbitrator or a judging committee will be appointed by parties involved who will arbitrate conflict between both sides in compliance with rules set by the center, contract as well as relevant documents. All parties have equal legal rights to present evidence and object any evidence or documents raised by another party.

Arbitration result will reveal who loses and who wins the argument. Both parties have to accept and respect the final judgment. In case when any party does not comply, another side can propose to court for further judgment based on the Article 52 of the Law on Economic Dispute Resolution revised in 2018. This process takes only three (3) months except when there is complication in gathering evidence or other reasons (Article 37 of the Law on Economic Dispute Resolution revised in 2018).

  • Judged by the people`s court

Dispute resolution at court is the final process that business people will refer to. This is the last resort because court process is usually prolonged involving a number of procedures. With too much time lost, entrepreneurs will miss many business opportunities. Nevertheless, if the affected party has already practiced all resolution methods but still cannot solve the issue they have, court judgment is then the last option. Court prosecution is normally divided into three (03) levels, namely trial court, appellate court, final court of appeal, with details below:

  • Trial Court

Business dispute is considered to be a commercial case which needs to be submitted to commercial court under the Provincial/Vientiane People`s Court. The court will finish its proceedings within 9 months based on the Article 30 Paragraph 1 of the Law on Civil Procedure revised in 2012.

  • Appellate Court

If any party is not satisfied with the verdict passed by the trial court, the party has the right to appeal to the appellate court (Central, Northern and Southern People`s Court) within 20 days starting from the verdict passing or hearing date. Appellate court shall complete prosecuting the case within 4 months based on the Article 30 Paragraph 2 of the Law on Civil Procedure revised in 2012.

  • Final Court of Appeal

If any party is not satisfied with the verdict passed by the appellate court, the party has the right to submit further to the final court of appeal (Supreme People`s Court) within 30 days starting from the verdict passing or hearing date. Final court of appeal shall finish its proceedings within 3 months based on the Article 30 Paragraph 3 of the Law on Civil Procedure revised in 2012.

When a case is being prosecuted, court will summon all parties involved to testify to gather information about the case. They will also do site inspection or request for relevant documents from the parties and open a court trial to proceed or prosecute the case (except for the final court of appeal).

All of what mentioned above are forms of dispute resolution which have different strengths and weaknesses. Finally, I hope that this article will serve as a piece of information helping busienss people making decisions more easily in choosing which way to address their business-related conflicts.
